1. General

By accessing or using the Service you agree to these Terms. If you do not agree, do not use the Service.

The Service provides an online classifieds platform for real-estate sale and long-term rent listings in Iraq, including natural-language search, maps, and WhatsApp contact links between users.

We may update these Terms from time to time. The current version is always published at /legal. Continued use after changes means you accept the updated Terms.

You may not use the Service where prohibited by the laws of your country of residence or the place from which you access the Service.

2. Role of the platform

Aqar Iraq is an intermediary information platform. We do not own, sell, rent, or broker the properties listed, unless we expressly state otherwise for a specific offer.

Contracts for sale or rent are concluded solely between users (owners, agents, developers, and seekers). We are not a party to those contracts and do not guarantee their performance.

Listing information is provided by users. We do not warrant that titles, prices, photos, availability, or legal status are accurate or complete.

3. Accounts and contact details

Some features (such as publishing a listing) may require providing contact details, including a WhatsApp number.

You are responsible for the accuracy of information you submit and for keeping access to your devices and messaging apps secure.

By submitting a WhatsApp number on a listing, you consent to seekers contacting you about that listing via WhatsApp.

4. Acceptable use

You agree not to: scrape or overload the Service; interfere with other users; upload malware; post illegal, fraudulent, discriminatory, or infringing content; impersonate others; or use the Service for spam or unauthorized advertising.

You must not attempt to disrupt our infrastructure, databases, or maps/POI integrations.

5. Intellectual property

The Service’s software, design, trademarks, and original content belong to Aqar Iraq or its licensors. You receive a limited, non-exclusive, non-transferable right to use the Service for personal or internal business purposes related to finding or listing property.

You may not copy, modify, or redistribute our materials for commercial purposes without prior written permission.

By publishing a listing you grant Aqar Iraq a worldwide, royalty-free license to host, display, index, and promote that content within the Service (including search, maps, and previews).

6. Third-party services

The Service may use map tiles, geodata, and nearby-place data from third-party providers. Their terms may apply.

WhatsApp is operated by Meta Platforms. Your use of WhatsApp is subject to Meta’s terms and privacy policy.

7. Disclaimer and limitation of liability

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE”. We do not guarantee uninterrupted or error-free operation, or that search results or recommendations will meet your goals.

To the fullest extent permitted by applicable law, Aqar Iraq is not liable for indirect, incidental, or consequential damages, or for disputes between users arising from listings or communications.

Nothing in these Terms excludes liability that cannot be limited under applicable law.

8. Suspension

We may remove content or restrict access if we reasonably believe these Terms, listing rules, or law have been violated, or to protect users and the Service.

9. Governing law

These Terms are governed by the laws of the Republic of Iraq, without regard to conflict-of-law rules, unless mandatory consumer protections in your jurisdiction require otherwise.

1. Who we are

The Service operates primarily for users in Iraq, with Arabic and English interfaces.

2. Information we collect

Listing and publish data you submit: titles, descriptions, price, property attributes, district/city, map coordinates, cover images, seller type, and WhatsApp number.

Search and usage data: queries, filters, language/theme preferences (often via cookies), pages viewed, and approximate technical logs (IP, user agent, timestamps) needed to run and secure the Service.

Map/nearby requests may send coordinates to our servers (and, when live data is fetched, to map/Overpass providers) to show places around a pin.

We do not require a full user account for browsing. Publish flows may store drafts pending review.

3. How we use information

To provide search, listing pages, maps, and WhatsApp contact links.

To review and publish drafts, prevent abuse and duplicates, and improve ranking or relevance (including AI-assisted copy suggestions and intent parsing).

To secure the Service, diagnose faults, and comply with legal obligations.

We do not sell personal data as a product.

4. Sharing

Public listing fields (including WhatsApp number you chose to publish) are visible to visitors of the Service.

Infrastructure and map providers process data as needed to deliver tiles, geocoding-related features, or nearby POI.

We may disclose information if required by law or to protect rights, safety, and integrity of the Service.

5. Cookies and similar technologies

We use cookies or similar storage for language (locale) and theme preferences.

6. Retention

Published listings and related media are kept while active and for a reasonable period after removal for abuse prevention and legal compliance.

Server logs are kept for a limited operational period unless a longer period is needed for security investigations.

7. Your choices

You may request correction or deletion of personal data you provided (subject to legal retention needs) by emailing legal@aqariraq.net.

You can change language/theme in the interface; clearing site data removes those cookies on your device.

To stop WhatsApp contact related to a listing, remove or unpublish the listing (or ask us to help) and manage WhatsApp settings in the Meta app.

8. Security and international processing

We apply reasonable technical and organizational measures, but no method of transmission or storage is fully secure.

Servers or vendors may be located outside Iraq; by using the Service you understand that processing may occur in other countries with different data-protection rules.

9. Children

The Service is intended for adults capable of entering property-related transactions. We do not knowingly collect data from children.

10. Changes

We may update this Policy. The “Last updated” date will change. Material changes will be reflected on this page.

1. What we mean by recommendations

“Recommendations” include: ranking or ordering of listings in search results; featured blocks on the home page; natural-language intent parsing that maps your query to filters; AI-assisted title/description suggestions when you publish; and map/nearby place suggestions around a property pin.

2. Signals we may use

Query text and explicit filters (city, deal type, rooms, price, etc.).

Listing attributes supplied by publishers (location, price, type, media).

Locale and theme preferences stored on your device.

Technical context needed for maps (coordinates you view or set).

We do not currently build advertising profiles for third-party ad networks on the Service.

3. Cookies and local storage

Language and theme cookies help keep the interface consistent across pages.

Disabling cookies may reset language/theme and impair some convenience features; core browsing of public listings generally remains available.

4. Why we use these technologies

To help you find relevant properties faster.

To help publishers write clearer bilingual listings.

To show useful map context (roads, nearby amenities) where data is available.

To protect the Service from abuse and low-quality or duplicate content.

5. Your controls

Refine or clear search filters; start a new query without previous intent.

Change language/theme; clear site data in your browser.

6. Changes

As we add personalization or advertising products, we will update this page and, where required, seek additional consent.

1. Allowed listings

Sale of residential or other property types supported by the form (apartment, house, land, commercial) where lawful.

Long-term rent (not short-term/daily stays as a primary offering, unless we later open that category explicitly).

Listings must relate to real property located in Iraq.

2. Who may publish

Owners, authorized agents, and developers may publish. You must have the right to advertise the property.

Do not publish another person’s property without authority. Misleading identity (fake owner/agent) is prohibited.

3. Content quality

Titles and descriptions must be truthful, readable, and relevant to the property. Prefer clear bilingual (Arabic and English) text when possible.

Avoid ALL-CAPS shouting, repeated punctuation (!!!), keyword spam, or empty marketing fluff with no property facts.

Prices and currency must match what you are actually offering. Update or unpublish when sold/rented.

4. Photos and location

Photos should depict the actual property (or faithful representations you are allowed to use). No stolen images, irrelevant stock collage spam, or UI screenshots as the main photo.

Do not overlay heavy ads, logos, or unrelated watermarks that obscure the property.

Map pins should reflect the real location as accurately as practical. Deliberately false pins are forbidden.

5. Contact

Provide a working WhatsApp number you are authorized to use. Seekers will contact you directly; Aqar Iraq is not a party to negotiations.

6. Prohibited

Fraud, phishing, money-mule schemes, or bait listings.

Discrimination or hate content.

Illegal property transactions or content that violates Iraq law.

Duplicates of the same active offer intended to spam search results.

7. Moderation

We may refuse, edit metadata for clarity, delay, or remove listings that breach these rules or law, with or without prior notice.

Repeated violations may lead to blocks on publishing.
